Conditions

These Terms and Conditions (“Terms”) apply to all consultations, appointments, treatments, services, products, packages, memberships, vouchers and promotional offers provided by The Elixir Clinic (“The Elixir Clinic”, “we”, “us” or “our”). 

By booking an appointment, attending the clinic, receiving a consultation or treatment, purchasing a service, package or voucher, or otherwise using our services, you acknowledge that you have read, understood and agree to these Terms. 

Nothing in these Terms affects any rights you may have under applicable law.

1. CONSULTATIONS

1.1 Mandatory Consultation 

A consultation with an appropriately qualified practitioner at The Elixir Clinic is mandatory before any treatment is undertaken. 

The consultation allows our practitioner to assess your individual circumstances, medical history, current medication, suitability for treatment, potential contraindications and any relevant risks. 

During the consultation, the practitioner may also discuss alternative treatments or services that may be more appropriate for you. 

Booking or requesting a particular treatment does not guarantee that the treatment will be provided. 

The final decision as to whether a treatment is clinically appropriate and safe will be made by the appropriately qualified practitioner following the consultation. 

1.2 Consultation Fee 

A consultation fee is applicable to consultations at The Elixir Clinic. 

The consultation fee is generally charged separately from the cost of any treatment. 

Where a patient proceeds with an eligible treatment on the same day as the consultation, The Elixir Clinic may, at its discretion, waive the consultation fee. 

Any waiver of the consultation fee is entirely at the discretion of The Elixir Clinic and is not guaranteed. 

Where a consultation is particularly lengthy, complex, requires additional clinical assessment, or where the practitioner considers that the consultation constitutes a separate or extended service, the consultation fee may remain fully chargeable even where treatment is subsequently undertaken. 

The applicable consultation fee will be communicated to you before the consultation. 

1.3 Treatment Suitability 

Not every treatment is suitable for every individual. 

Our practitioners reserve the right to decline, postpone, modify or discontinue a treatment where they consider this necessary for your health, safety or wellbeing. 

Where a requested treatment is not appropriate, we may recommend an alternative treatment or service, or recommend that you seek advice from another healthcare professional. 

2. PREGNANCY AND BREASTFEEDING

For safety reasons, certain treatments offered by The Elixir Clinic may not be suitable for patients who are pregnant or breastfeeding.

Patients who are pregnant, believe they may be pregnant, or are breastfeeding must inform The Elixir Clinic before treatment and disclose this information during their consultation.

Pregnant and breastfeeding patients are welcome to attend the clinic for a consultation.

A consultation may allow our practitioner to determine whether other services or treatments offered by The Elixir Clinic may be appropriate and safe for the individual.

No treatment will be carried out where the practitioner considers it unsuitable or unsafe due to pregnancy, breastfeeding, medical history, medication or any other relevant clinical circumstance.

The final decision regarding treatment suitability will always be made by the appropriately qualified practitioner following an individual assessment.

3. MEDICAL INFORMATION AND DISCLOSURE

You are responsible for providing accurate, complete and up-to-date information regarding your health and circumstances.

This includes, where relevant:

  • Medical conditions;
  • Allergies;
  • Current and recent medication;
  • Prescription medication;
  • Supplements;
  • Previous procedures or treatments;
  • Pregnancy or breastfeeding;
  • Previous adverse reactions;
  • Relevant surgical history; and
  • Any other information reasonably requested by our practitioner.

Failure to provide accurate or complete information may affect the safety and suitability of your treatment.

You must inform The Elixir Clinic of any relevant changes to your health or circumstances between your consultation and treatment.

A previous consultation or treatment does not automatically mean that a treatment remains suitable if your circumstances have changed.

4. CONSENT

Appropriate consent must be obtained before treatment is undertaken.

You will have the opportunity to ask questions and discuss relevant risks, benefits, alternatives and expected outcomes before proceeding.

Consent may be withdrawn at any time before or during treatment, subject to any necessary clinical considerations.

Where appropriate, you may be required to complete and sign a treatment-specific consent form.

5. PRICING

5.1 Wellness Menu

Treatment pricing is available through our Wellness Menu, which is available on request.

We do not publish fixed treatment prices within these Terms and Conditions because pricing may vary depending on the treatment and individual requirements.

Prices may vary between treatments and may depend on factors including:

  • Treatment type;
  • Dosage;
  • Quantity;
  • Individual requirements;
  • Formulation;
  • Treatment duration;
  • Additional services or products; and
  • Any clinically appropriate adjustments recommended by the practitioner.
5.2 Pricing Confirmation Before Treatment

The final cost of your treatment will be communicated to you before the treatment begins.

The Elixir Clinic does not generally take payment for treatment before the treatment starts, except where a deposit is specifically required for a particular service.

Following your consultation and once the treatment requirements have been determined, our team will provide you with an invoice and/or pro forma invoice setting out the expected cost of the services to be provided.

You will have the opportunity to review the proposed cost before treatment begins.

If you are happy with the stated price and wish to proceed, treatment will then commence.

If you have any questions, concerns or believe there is a discrepancy in the pricing or services outlined, please raise this with a member of our team before treatment begins.

Our team is available to support you and clarify any aspect of the proposed treatment or pricing.

6. DEPOSITS

Certain treatments or services may require a deposit to secure an appointment.

Where a deposit is required, the amount and applicable terms will be communicated to you at the time of booking.

Unless otherwise stated, a deposit is redeemable against the relevant treatment or service and will be deducted from the final amount payable for that treatment.

Deposits are non-refundable, subject to any rights that cannot lawfully be excluded.

Where a patient cancels an appointment, fails to attend, or otherwise does not proceed with the booked treatment, the deposit may be retained by The Elixir Clinic in accordance with the applicable booking and cancellation terms.

A deposit does not guarantee that treatment will be provided where, following the mandatory consultation, the practitioner determines that the treatment is not clinically appropriate or safe.

Where treatment cannot proceed for clinical reasons, The Elixir Clinic will determine how the deposit is dealt with having regard to the circumstances and applicable law.

7. PAYMENT

Payment for treatment is due following confirmation of the treatment and the applicable price.

The final amount payable will be communicated to you before treatment begins.

Where a deposit has already been paid, the deposit will be deducted from the final treatment cost where applicable.

Where the treatment, dosage, quantity or services provided change following clinical assessment, any resulting change in price will be communicated to you before the additional or amended service is provided wherever reasonably practicable.

If you are unsure about any element of your invoice, pro forma invoice or treatment cost, you should speak to a member of the team before proceeding.

8. APPOINTMENTS

Appointments must be booked through The Elixir Clinic’s approved booking channels.

When booking an appointment, you are responsible for providing accurate contact details and any information reasonably requested by the clinic.

Appointments are subject to availability.

We reserve the right to decline or postpone an appointment where this is necessary for clinical, safety, regulatory or operational reasons.

9. CANCELLATIONS AND NO-SHOWS

If you need to cancel or rearrange an appointment, please provide as much notice as possible.

Where a deposit has been taken, the deposit is non-refundable and may be retained in accordance with the applicable cancellation terms.

A failure to attend an appointment without appropriate notice may be treated as a no-show.

In the event of a no-show, The Elixir Clinic reserves the right to retain any deposit paid and may require future appointments or treatments to be secured by a further deposit or other payment arrangement.

Where an appointment is cancelled or rearranged, the applicable cancellation conditions communicated at the time of booking will apply.

Repeated cancellations, late cancellations or no-shows may result in The Elixir Clinic requiring advance deposits or other booking conditions for future appointments.

Where a cancellation or rearrangement is necessary for clinical or safety reasons, we will consider the circumstances and discuss the available options with you.

Nothing in this section affects any statutory rights that may apply.

10. LATE ARRIVALS

Please arrive on time for your appointment.

If you arrive late, we will make reasonable efforts to provide your consultation or treatment where sufficient time remains.

However, if your late arrival means that there is insufficient time to safely or appropriately provide the service, your appointment may need to be shortened, rearranged or cancelled.

Any applicable cancellation, no-show or deposit policy may apply.

11. TREATMENT RESULTS

The Elixir Clinic provides treatments with reasonable care and skill and in accordance with applicable professional standards.

However, individual responses to treatments vary.

We do not guarantee a particular medical, aesthetic, cosmetic, wellness or therapeutic outcome.

Results may depend on individual circumstances, treatment suitability, adherence to aftercare instructions, lifestyle and the individual’s response to treatment.

Where multiple treatments or ongoing management may be required, this will be discussed with you where reasonably possible.

12. AFTERCARE

You must follow all aftercare instructions provided by The Elixir Clinic.

Aftercare instructions may be provided verbally, in writing or electronically.

Failure to follow aftercare instructions may increase the risk of complications or affect the outcome of your treatment.

If you experience unexpected symptoms or concerns following treatment, you should contact The Elixir Clinic promptly where appropriate.

If you believe you require urgent medical attention, you should seek appropriate medical assistance rather than waiting for a response from the clinic.

13. MEDICINES AND PRESCRIPTIONS

Where The Elixir Clinic provides prescription-only medicines or other regulated medicines, these will only be prescribed or supplied where clinically appropriate and in accordance with applicable law and professional requirements.

A prescription or particular medication is not guaranteed simply because it has been requested by a patient.

You must provide accurate information regarding your medical history, medication, supplements and allergies.

You must follow the instructions provided by the prescribing practitioner and/or supplied with the medication.

You must not share prescribed medication with another person.

If you experience a serious or unexpected reaction, you should seek appropriate medical assistance.

14. PATIENT RESPONSIBILITIES

Patients are expected to:

  • Provide accurate and complete information;
  • Disclose relevant medical conditions, medication and allergies;
  • Inform us of pregnancy or breastfeeding;
  • Inform us of any relevant changes in health or circumstances;
  • Follow clinical and aftercare instructions;
  • Attend appointments on time;
  • Follow reasonable clinic safety procedures; and
  • Treat our staff, practitioners and other patients respectfully.

The Elixir Clinic does not tolerate abusive, threatening, discriminatory, intimidating or aggressive behaviour towards staff, practitioners or other patients.

Where necessary and appropriate, we may refuse service or terminate a patient relationship in accordance with applicable professional and legal requirements.

15. CHILDREN AND YOUNG PEOPLE

Certain services may have minimum age requirements.

Where a patient is under 18, additional consent, safeguarding or parental/guardian requirements may apply depending on the service and applicable law.

The Elixir Clinic will not provide a treatment where doing so would be clinically or legally inappropriate.

16. TREATMENT PACKAGES AND PARTNER CLINICS

Where The Elixir Clinic provides treatment packages, memberships or other arrangements involving multiple treatments, the applicable package terms will be communicated before purchase.

Packages and treatments are generally intended to be redeemed at the relevant The Elixir Clinic branch or location for which they were purchased or agreed.

Treatment packages, memberships, prepaid services or other treatment arrangements may not be used at partner clinics or other locations unless this has been expressly agreed in advance by The Elixir Clinic.

Any agreement allowing a client to use a package or treatment at a partner clinic must be expressly confirmed by The Elixir Clinic.

Such confirmation may be provided:

  • By email, where a written email trail confirms the agreement; or
  • By an official written letter or other written confirmation from The Elixir Clinic.

Verbal discussions or assumptions that a package may be used at another clinic will not, by themselves, constitute confirmation unless subsequently confirmed in writing by The Elixir Clinic.

17. VOUCHERS AND COUPONS

The Elixir Clinic may issue vouchers, gift vouchers, coupons or other promotional certificates from time to time.

All vouchers and coupons are subject to the specific terms and conditions applicable to the relevant voucher or promotion.

Where a voucher has an expiry date, it must be used before that expiry date.

Expiry dates cannot ordinarily be extended.  Any extension of an expiry date is entirely at the discretion of The Elixir Clinic and is not guaranteed.

Vouchers and coupons must be presented in a condition that allows The Elixir Clinic to verify their validity and authenticity.

The Elixir Clinic reserves the right to refuse a voucher or coupon where it has been:

  • Damaged;
  • Ripped or materially altered;
  • Defaced;
  • Tampered with;
  • Duplicated or reproduced;
  • Misused; or
  • Otherwise unable to be reasonably verified as valid.

Vouchers and coupons cannot be exchanged for cash unless otherwise expressly stated.

Vouchers may not be transferred or combined with other offers unless expressly permitted by the applicable voucher terms.

18. PROMOTIONAL OFFERS

Promotional offers are subject to any specific terms stated in the relevant promotion.

Unless expressly stated otherwise, promotional offers:

  • Cannot be combined with other promotional offers;
  • Cannot be exchanged for cash;
  • Cannot be transferred; and
  • May be subject to availability.

The Elixir Clinic reserves the right to withdraw, amend or discontinue a promotional offer where permitted by law.

19. REFUNDS

Refunds will be considered in accordance with applicable law and the circumstances of the purchase.

Where a treatment has already been provided, a refund will not automatically be available simply because a patient is dissatisfied with the outcome, where the treatment was provided appropriately and in accordance with the agreed service.

This does not affect any statutory rights that may apply.

Deposits are non-refundable except where otherwise required by applicable law.

20. COMPLAINTS

We want every client to receive a professional, safe and positive experience.

If you have a concern or complaint regarding our services, treatment, staff or care, please contact us as soon as reasonably possible so that we have the opportunity to investigate and respond appropriately.

Where applicable, you may also have the right to raise concerns with the relevant professional or regulatory authority.

21. MEDICAL RECORDS AND CONFIDENTIALITY

We maintain appropriate records relating to consultations, treatments and care.

Personal and health information will be handled confidentially and in accordance with applicable data protection legislation and healthcare confidentiality requirements.

Information may be shared with other healthcare professionals involved in your care where appropriate, necessary and lawful.

Information may also be disclosed where we are legally required or permitted to do so.

22. COMMUNICATION

We may contact you using the contact details you provide for purposes including:

  • Appointment confirmations;
  • Appointment reminders;
  • Treatment-related communications;
  • Aftercare;
  • Follow-up;
  • Results or information relating to your care;
  • Administrative matters; and
  • Other communications where permitted by law.

You are responsible for ensuring that the contact details you provide remain accurate and up to date.

24. WEBSITE AND ONLINE INFORMATION

We take reasonable care to ensure that information published on our website and official communication channels is accurate and up to date.

However, information published online is provided for general information and should not be treated as a substitute for an individual consultation or professional medical advice.

Treatment suitability can only be determined following an appropriate individual assessment where required.

25. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

Subject to the above, The Elixir Clinic will not be responsible for losses arising from information supplied by a patient that is inaccurate, incomplete or misleading, or from a patient’s failure to follow clinical or aftercare instructions, to the extent permitted by applicable law.

26. EVENTS OUTSIDE OUR REASONABLE CONTROL

The Elixir Clinic will not be responsible for delays, cancellations or interruptions caused by circumstances beyond our reasonable control.

This may include serious staff illness, emergencies, equipment failure, utility failure, building issues, natural events or other circumstances that make it unsafe or impractical to provide a service.

Where possible, we will contact affected clients and arrange an alternative appointment or appropriate solution.

27. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes in our services, legal requirements, professional requirements or clinic procedures.

The most current version will be made available through The Elixir Clinic and/or our website.

28. GOVERNING LAW

These Terms are governed by the applicable laws and regulations of the United Arab Emirates and the relevant Emirate in which the applicable services are provided, unless applicable law requires otherwise.

Any dispute shall be subject to the jurisdiction of the appropriate courts or competent authorities, subject to any mandatory rights or requirements under applicable law.
